Subject: ElectronicCommunicationsPrivacyAct (HD Scan)
   From the ECPA, enacted 1986.

Relevant portions:

Q u o t e:
any person who--
(a) intentionally intercepts, endeavors to intercept, or procures any other person to intercept or endeavor to intercept, any wire, oral, or electronic communication;
shall be punished as provided in subsection (4) or shall be subject to suit as provided in subsection (5).

Except that:

Q u o t e:
(d) It shall not be unlawful under this chapter for a person not acting under color of law to intercept a wire, oral, or electronic communication where such person is a party to the communication or where one of the parties to the communication has given prior consent to such interception unless such communication is intercepted for the purpose of committing any criminal or tortious act in violation of the Constitution or laws of the United States or of any State.

Personally, I don't like a company scanning your hard drive for any reason. It is however, perfectly legal. If you don't like it, I suggest you contact the Electronic Frontier Foundation at http://www.eff.org/. Voice your concerns to the white hats there and see if anyone will come to help.

Subject edited for more views/responses. Apologies for cramming everything together.

   Blizzard has always taken an aggressive stance against cheating in our games, and this measure, as discussed clearly in our Terms of Use, is an example of our efforts to protect legitimate players and the integrity of the game service from those attempting to gain an unfair advantage through the use of hacks. As stated in the Terms of Use, the information we obtain is solely for the purpose of identifying cheating in World of Warcraft and for no other reason. Please note that we do not share this information with anyone outside of Blizzard.

(Yes, this is precisely what the European folks said. It's what we're authorized to say, and no more.)
